This legal document is automatically liable between PARTY A, “Garden of Ads” (commonly GoA and its direct or indirect employees/partners), and PARTY B, “clients who hire GoA” for any services.
Due to the broad nature of the services Garden of Ads offers, each service has its respective Terms and Conditions. GoA mainly offers six services: Advertisement, Online Reputation Management, Content Writing, Search Engine Optimization, Web Development, and Social Media Marketing.
Once a service is consulted about and fixed between both parties, an invoice will be delivered to PARTY B within 48 hours from PARTY A. The invoice needs to be paid by PARTY B within 48 hours of receiving it; Otherwise, the service will be canceled.
A contract will start from the payment date (referring to as the transaction date), and GoA will only entertain orders after payment confirmation. A timezone difference of 12 hours is acceptable for all dates.
Refund Conditions
All transactions are made in USD, and the refunds are subject to the same. Garden of Ads is not responsible for any currency exchange rate. For third-party errors, such as Gmail’s failure to send an email or the unavailability of devices/internet due to natural disasters, the dates will be adjusted if proven legally. All refunds need to be claimed within 48 hours of the incident/approach/outcome or as applicable.
1. Advertisement
Third-party purchases like capital spent on ad campaigns are non-refundable from GoA.
All services under Advertisement Category are monthly charged and are applicable to a 100% refund if canceled within 48 hours from the first transaction date. A cancellation fee of 30% is applicable if canceled within 7 days (after the first 48 hours of the first month), and 70% is applicable after 7 days of the transaction of each billing month.
2. Online Reputation Management (ORM)
All ORM services are 100% refundable if canceled within 24 hours of the transaction date. After 24 hours, a cancellation fee of 30% is applicable. If third-party purchases are needed, such as buying IMDb’s pro membership, their fees won’t be refunded.
Wikipedia: For new Wikipedia pages, a refund of 50% is applicable if the page is deleted/removed within 7 days of publishing. For existing pages’ updates, a refund of 65% is applicable if the updates are deleted/reverted within 7 days of publishing.
IMDb: For new IMDb profiles, a refund of 90% is applicable if the project is unsuccessful. Refunds are unavailable for IMDb updates or after 15 days of the outcome.
Negative Content Removal: A refund of 80% is applicable if the project is unsuccessful. Refunds are not applicable after 15 days from confirmation of the project’s success by PARTY B.
Press Release: Once an article has been published under the Press Release service, PARTY B is no longer eligible for any refunds. All cancellations must take place before the publication. For any corrections in the published articles, PARTY B needs to claim revision within 48 hours of the published date.
Podcast: If a Podcast has been fixed and confirmed by both parties, a 60% cancellation fee is applicable before 48 hours of the appointed date of the podcast. Any cancellations within 48 hours of the appointed date will not be subject to the refund conditions.
3. Content Writing
All Content Writing services are applicable to a 90% refund fee if canceled within 48 hours from the transaction date. After the first 48 hours, a cancellation fee of 50% is applicable on orders worth $500 USD (and more), and a 20% cancellation fee if an order is less than $500 USD. Once the content is submitted for review to PARTY B, any cancellation will cost a 75% fee of the total order. No refunds are applicable after 24 hours once the content is approved by PARTY B.
4. Search Engine Optimization (SEO)
All SEO services are charged on a monthly basis and are subject to a 100% refund if canceled within the first 48 hours of the transaction date. It is suggested to run an SEO service for at least 6 months to see any changes.
On-Page SEO: 50% cancellation fee if an order is canceled within 12 days (except the first 48 hours ever) of the transaction date or a new month’s beginning. No refunds are applicable after 12 days of a particular billing month.
Off-Page SEO: 60% cancellation fee if an order is canceled within 7 days (except the first 48 hours ever) of the transaction date or a new month’s beginning. No refunds are applicable after 7 days of a particular billing month.
Airbnb SEO: 50% cancellation fee if an order is canceled within 5 days (except the first 48 hours ever) of the transaction date or a new month’s beginning. No refunds are applicable after 5 days of a particular billing month.
YouTube SEO: 60% cancellation fee if an order is canceled within 7 days (except the first 48 hours ever) of the transaction date or a new month’s beginning. No refunds are applicable after 7 days of a particular billing month.
5. Web Development
Refunds are not applicable on third-party purchases like hosting from GoDaddy or domain registration from Google.
Website Creation: 30% cancellation fee when development is in progress. 75% cancellation fee after the first design is delivered for review. No refunds are applicable after 45 days from the transaction date, irrespective of the progress.
Website Fixing: 50% cancellation fee when fixing is in progress. No refunds are applicable after the errors have been fixed and confirmed (by PARTY B through email or other methods) or 45 days from the transaction date, irrespective of the progress.
Website Upgrade: 25% cancellation fee when an upgrade is in progress. No refunds are applicable once the upgrade is completed and confirmed (by PARTY B through email or other methods) or 45 days from the transaction date, irrespective of the progress.
6. Social Media Marketing (SMM)
All services under Social Media Marketing category are subject to a 100% refund if canceled within 48 hours from the transaction date. Third-party purchases, such as expenditures on ad campaigns, are non-refundable. This is a monthly paid category.
A cancellation fee of 50% is applicable if an order is canceled within 7 days transaction date (except the 48 hours of the first month). After 7 days of a billing month, no refunds are applicable.
